Over 100 years ago, our Supreme Court deemed access to the judicial system to be “one of the highest and most essential privileges of citizenship.” However, recent events across our country, in places like Ferguson, Staten Island, and Cleveland, have made it more clear than ever before, to more Americans than ever before, that equal access to justice is an ideal that we must work much harder to realize.
Throughout our history, landmark legal cases like Brown v. Board of Education, Gideon v. Wainwright, and Roe v. Wade changed the lives of ordinary Americans, especially for those living at the margins of society, forever. Where the legislature was bound by partisanship, the judicial system rose above politics to hand down decisions with far reaching social implications. In their piece, Moving Forward Social Causes Through Impact Litigation, Lara Bergthold and Felix Schein of RALLY state, “litigation presents a chance to change the conversation where ballot measures and bills have hit a wall. It’s disruptive, cutting through the noise and the politics and allowing the facts to surface. Political debates and campaigns can be hijacked by misleading advertising and superior rhetoric, but in a courtroom, nothing matters but the facts.”
Unfortunately, prohibitive costs of legal representation, court fees, associated trial costs can exclude most lower and middle income Americans from participating in the justice system. Because the right to an attorney is only guaranteed in criminal cases, an astonishingly high number of legitimate legal matters never make it to the courtroom.
